ArtSeal Terms of Service

Beta v0.1 — pending attorney review; material changes will require renewed acceptance.

1. These Terms and the beta

These Terms govern access to artseal.app, the ArtSeal Trainer and Tester, and optional Studio Compute (together, the "Services"). The Services are in beta and may change, pause, or end.

By creating an account, or by using the Services after these Terms take effect, you agree to these Terms and to the documents incorporated into them:

  • the Acceptable Use / Content Policy;
  • the Privacy Policy;
  • the public summary in the Data Retention Policy; and
  • the Copyright Complaint Policy.

Account creation asks you to confirm your age and accept these Terms and the Privacy Policy. ArtSeal records that acceptance: which document versions you accepted, when, and the request context. That record is described in the Privacy Policy and is not published.

2. Eligibility and accounts

You must be 18 or older to use the Services. The beta is offered in the United States. ArtSeal does not knowingly provide the Services to anyone under 18 and will close an account it learns belongs to a minor.

Provide accurate account information, protect your credentials, and tell ArtSeal promptly if you suspect unauthorized use. You are responsible for activity under your account to the extent permitted by law. Do not share a Studio Compute passphrase outside the invited participant it was issued to.

Your public display name may differ from your legal name. ArtSeal may ask for verification where a record, payout, safety issue, or legal obligation requires it.

3. Your content and your rights

"Your Content" means artwork, model files, prompts, text, profile information, manifest data, and other material you submit.

As between you and ArtSeal, you keep whatever intellectual-property rights you hold in Your Content. These Terms transfer no ownership of your artwork or your trained LoRA to ArtSeal.

You grant ArtSeal a limited, non-exclusive, worldwide license to host, copy, transmit, process, hash, encrypt, format, and display Your Content only as needed to:

  • provide, secure and operate the Services;
  • publish content you deliberately mark public;
  • create and publish resized or re-encoded display copies, including the low-resolution copy made for a verified original;
  • store an encrypted model master and produce test-mode stamped copies;
  • make backups and recover service data; and
  • comply with law and enforce these Terms.

The license lasts while the relevant content or account remains, plus the time reasonably required for deletion, backups, legal obligations, and the record limits described in Section 10. For public record facts and blockchain metadata, the license includes the permanent storage and public display needed to keep that record understandable.

4. Your representations about content

When you upload or publish content, you represent that:

  1. you own it or hold the rights and permissions needed to submit it and to grant Section 3's limited license;
  2. your submission and ArtSeal's permitted handling do not knowingly violate another person's copyright, trademark, privacy, publicity, contract, or other rights;
  3. anything you label "Original" is artwork you are entitled to present as your original work, and anything you label "Generated" was generated using the model or workflow you describe;
  4. you will not present generated output as source artwork in the original-work gallery; and
  5. your content and conduct follow the Acceptable Use / Content Policy.

These are your representations. ArtSeal records them. ArtSeal does not decide who legally owns disputed artwork.

5. Original and generated work stay separate

The showcase places original and generated work in separate sections and labels each image. Do not defeat, obscure, or misstate that separation.

A verified-original badge means only that the uploaded bytes matched a member of the listing's committed file set, and that the displayed copy was derived from those bytes. It does not establish ownership, authorship, or legal permission.

6. Records are evidence, not ownership findings

ArtSeal may record identity or payment-provider status, a person's attestation, file digests and byte counts, commitments and membership matches, test payments, terms, delivery facts and timestamps, and transaction metadata read from a public test network.

ArtSeal checks facts that can be mechanically checked and records claims made by people. It does not determine that an artist owns an image, that an attestation is true, that every use complies with a separate agreement, or that an AI-assisted output is copyrightable. The absence of an ArtSeal record is not a verdict about a work, a person, or a license.

Any future "ArtSeal Certified" title badge is outside these Terms and will have its own rules. No beta record authorizes use of that badge.

7. No LoRA license is granted under these Terms

These Terms govern the platform and the beta Services only. They do not grant, purchase, form, transfer, or define a license to use an artist's LoRA or artwork. License-tier cards and current checkout flows are previews or test transactions. They mint no real license and move no real money.

Any future LoRA licensing will use a separate transactional agreement set addressing the artist, the licensee and ArtSeal. Do not rely on these Terms as permission to possess, use, redistribute, sublicense, or commercialize a LoRA.

8. Acceptable use

You must follow the Acceptable Use / Content Policy. In particular: do not upload material you lack permission to use; do not exploit children; do not offer an adult-content LoRA during the pilot; do not impersonate another person; do not upload malware; do not evade access controls; do not scrape the Services; and do not interfere with another user or with the Services.

9. Copyright complaints

ArtSeal handles copyright notices and counter-notices under the Copyright Complaint Policy. ArtSeal may remove or disable content while a claim is resolved. That operational act is not a ruling about ownership.

ArtSeal may terminate the accounts of repeat infringers.

10. Moderation, suspension, and termination

ArtSeal may reject, remove, restrict, or disable content, and may suspend or terminate access, when reasonably necessary to enforce these Terms, protect the Services or users, respond to legal process, or manage the invite-only beta.

An ArtSeal action is a platform decision, not a judgment about ownership or liability. Use Contact to appeal or to provide context.

You may stop using the Services at any time. There is no self-service account-deletion flow yet; requests go to the contact address in the Privacy Policy. Removing an account may not remove:

  • material copied by others, search engines, archives, or caches;
  • records ArtSeal is legally required to keep;
  • immutable evidence records, which stay readable after the deleted account is detached from them; or
  • hashes and IDs already written to a public blockchain.

11. Third-party services and open-source components

The Services depend on the third parties listed in the Privacy Policy, with their roles. Their own terms may apply to their direct relationship with you. ArtSeal does not control a third party's availability.

The desktop apps also download third-party software and model weights from public sources, including Hugging Face, download.pytorch.org and PyPI, subject to their own licenses. A complete third-party notice list will accompany a later version of these Terms.

12. Beta changes and availability

The beta carries no service-level commitment. Features, formats, storage, limits and availability may change. ArtSeal may revoke an invitation or stop Studio Compute. Keep your own copies of artwork, manifests, model files and generated output. ArtSeal is not the archive for any of them.

13. Warranty disclaimer

To the maximum extent permitted by applicable law, the Services are provided "as is" and "as available," without warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, or uninterrupted operation. ArtSeal does not warrant that an attestation is true, that content is legally owned, that AI-assisted output is protectable, or that a record prevents misuse.

Nothing in this section excludes a warranty that applicable law does not permit ArtSeal to exclude.

14. What this version deliberately leaves out

This Beta v0.1 contains no limitation of liability, no indemnity, and no arbitration or class-action waiver. Those clauses allocate risk between you and ArtSeal, and ArtSeal will not write them without its attorney. Their absence is deliberate, not an oversight, and nothing in this version waives a right either party has under applicable law.

A later version reviewed by counsel may add such terms. It will be published as a new version with a new effective date, and you will be asked to accept it — that is what "material changes will require renewed acceptance" means at the top of this document.

15. Governing law

These Terms are governed by the law of the State of Michigan, without regard to its conflict-of-law rules, except where a mandatory consumer-protection rule of your home jurisdiction applies. Venue and dispute procedure are among the terms left to the later version described in Section 14.

16. Changes to these Terms

Each version of these Terms carries a version label, an effective date, and a published hash of its text. ArtSeal will give notice of material changes and ask for renewed acceptance where the change warrants it. Continued use alone is not treated as acceptance of a material change.
